Legal Question in Bankruptcy in New York
Inheritance after filing a Chapter 7
My husband filed full Bankruptcy (I think Chapter 7 - all debts were discharged) in the fall of 1999. The proceedings were started before we were married (winter of 1999) but he did not receive the ''discharge'' until a few months after we were married. I know that any monies my husband receives, i.e. inheritance, settlements etc go back to pay off the creditors.
My question -- my Father recently passed away and we were concerned that I would loose my part of the estate because of the bankruptcy. Will the monies I receive from my Dad's estate be taken away to pay back the creditors?
