Intellectual Property Retention in Chapter 11 Cases
If a small corporate entity (or a small corporation currently owned by another) files chapter 11, can the owner of this public company retain some intellectual property despite the new buyers? Is there a provision in section 363 of the U.S. Bankruptcy code that may account for this issue?
