Legal Question in Bankruptcy in New York
Does the means test apply to a Chapter 7 filing, if more than 50% of the unsecured debt can be shown to have been due to a business venture? (New York State) In other words, is there a limit to the total unsecured debt, or to the total income, that would disqualify or prevent a Chapter 7 filing, if > 50% of the unsecured debt was due to a business venture?
