Legal Question in Bankruptcy in New York

mother's debt

My mother recently passed away and left my father in about $15,500 in credit card debt. His name is primary on the cards.My father will now be living a a VERY fixed income. My mother worked up to the day before she passed and also collected her social security so that is a large chunk of change he'll be missing. We wanted to know if it would be best to file bankruptcy, but he owns his home that is probably assessed at around $50,000. He is in failing health and has never been involved in the finances of keeping the house. My sister and I are at a loss as to how to get him out of debt.

This is a problem I saw many times in my work with Legal Aid. There are no 100% solutions, but he can be assisted.

The solution lies in the area of estate planning combined with Bankruptcy law. This is something you should be doing even without the issue of the credit card debt.
