Legal Question in Bankruptcy in New York
Personal Property
My daughter is thinking about filing for Chapter 7. I would like to know if her car would be taken away from her. I was told that it might be a possibility if its worth under $5,000. This is her only means of transportation to and from work. Is this possible? This is really the only thing she owns besides some furniture and jewelry which is worth minimal amounts. Thank you.

This is how lawyers are helpful.
NY State has opted out of the federal exemptions and the NY State exemptions under the GBL control the issue.
There are general exemptions under which the car can be retained.
