i was rear ended in a car accident, can i sue the person that hit me while in the bankrupcy process in N.Y

If it is the other person that has filed for bankruptcy - you can sue if the accident occurred after the filing date of the bankruptcy. If the accident occurred before the filing, then that person's liability is most likely discharged. However, if there is insurance coverage, then you may be able to pursue the insurance coverage only. You should consult with an attorney as the specifics of your case will determine how you may proceed.
