Legal Question in Bankruptcy in New York

Social Security Disability and Pension Payments

I receive Social Security Disability Payments and collect a Civil Servive Retiree Pension. Are these payments counted as income if I file Bankruptcy? I have been collecting a pension for 11 months and Social Security Disability Payments for 6 months.

Re: Social Security Disability and Pension Payments

Yes. Both of these sources of income are "income" for bankruptcy purposes. Actually, all income must be reported on a bankruptcy petition.

However, for purposes of calculating the means test, you do not have to include Social Security payments.

I have a wealth of information on bankruptcy law on my website, BankruptcyCanHelp.com, including information about the means test, qualifying for bankruptcy, etc.
