Legal Question in Bankruptcy in New York
Do I Have a Stay or Not?
I just filed bankruptcy to stop my landlord in L&T court, I just wanted to know, with the new Laws and everything, I just wanted to know if I have a stay or not. The judge in L&T court did not issue a judgment yet, the trial was supposed to be this Friday, and the last time I filed bankruptcy was around 1998 or so. Can anyone please tell me if I have a stay in L&T court or not? Any input you can provide would be very much appreciated.

Re: Do I Have a Stay or Not?
The back rent is uncollectable based on the bankruptcy filing, but you may still be evicted. There are some L & T cases on this point and I believe that the eviction is not stayed.
The cases supporting eviction came down in 2003.
Do not rely on the stay .
There are still things a knowledgable L & T lawyer can accomplish for you.
