Legal Question in Bankruptcy in New York
I was being sued by an auto insurance company due to auto accident where my insurance company wouldn't pay because I was not driving the car. I had a court date to appear in civil court to try to fight the law suit but decided not to show up because I am considering filing bankruptcy. Would it be harder to file bankruptcy because I didn't appear in court? How much does it cost to file bankruptcy?

First, filing bankruptcy will discharge your obligation in a negligence action or judgment. This is true unless you were convicted of a dui or dwi or if the accident was intentional. Second, a Chapter 7 Bankruptcy usually costs about $1,500 and a filing fee of $299.
