Legal Question in Bankruptcy in New York

tax refund

I am filing a chapter 7. My tax refund will be bigger this year because of school, and i am getting more back because of the grants i recieved from school. i had to claim all this on my tax return. My parents are paying for my education. Can the creditors take the $1752 im getting back even if im not keeping the money and its all going back to paying for school? I have been told the creditors can take all of your tax refund. If they take this money i will have have to drop out of school because my parents will have no way to pay for my semester.

You should meet with a bankruptcy attorney to discuss your situation.

Your Tax refund may or may not be exempt depending upon your other asssets.

You should noy try to do the bankruptcy yourself, because you will not have an attorney to protect your assets.
