Legal Question in Bankruptcy in New York
Our tenant has recently filed Chapter 7. The lease has expired, and we are going month to month. Do we need to do anything? Do they need to continue to pay their rent? We don't want to evict them, as they are up-to-date with their rent, but we can't have tenants who do not have to pay rent.

Under the bankruptcy laws your tenant is required to pay rent unless he/she is asking for a temporary stay of an eviction (usually last about 30 days). There is nothing for you to do as long as the tenant is up to date with his/her rent.
