Legal Question in Bankruptcy in New York

What happens in trustee meets.....

What kind of questions are asked in the trustee meetings? what do the creditors usually ask if they show up and if they dont,what does the trustee want to know? What documents do you need to bring?What do the questions refer to? How long does it usually take and does it have to be in the county where the court is? Flying completely blind here, and need help!

also,what is the NY civil code you nedd to put on scheduel C for the exemptions? As best I can make out from the library book I am using,you have to choose between federal and state code ,but I am not sure I am deciphering them correctly and I think NY would be best.

Bankruptcy is actually a very complicated area of Law, and the issue of exemptions is very Important.

I am glad to see that you have been researching the bankruptcy laws prior to interviewing your prospective bankruptcy attorney.

I would suggest you interview 2-3 attorneys, and use the one you are most comfortable with.

If you are thinking of doing this on your own, consider this. It is not unusual to sit around for 2 hours at the Trustee hearing. If you make a mistake, the Trustee will make you correct it, and then make you come back another day and sit around for 2 hours. At the 2nd hearing, the Trustee will pickup where he left off, and if he finds another mistake --- well I am sure your are getting the picture.

Be confidant. The Trustee schedules 10 cases for a one hour period and one case always takes about 15 minutes. So that leaves little time for you.

The trustee asks only the most basic questions and you will have no trouble (name, real address, actual income, etc...).
