Legal Question in Bankruptcy in New York

Wage Garnishment

I know a law firm can garnish your wages if a credit card company has a judgement against you. My question is can they garnish social security wages and pension wages? I live in New York State.

Re: Wage Garnishment

A creditor cannot garnish social security or pension proceeds. However, they will not know that the funds they are garnishing are exempt unless you tell them.

This means that they can freeze your account, and the burden would then be upon you to explain to them, quickly, with sufficient written proof, that all of the funds in your account are protected funds.
