Legal Question in Business Law in New York

accident

My Question is if you have a garnishy on you weekly payroll check and you were to get in a car accident and have a settlement coming to you for pain and suffering would the garnishy debt be takin out of the settlement before you got any of it????? Thank you!!!

The settlement is subject to attachment if a lien is filed...it will not be garnisheed...it will be liened for the entire amount owed.

If the creditor learns of it and serves an execution upon the payor it can be taken out of the settlement proceeds.
