Legal Question in Business Law in New York

Alcoholic Beverage Market Research

I am going to be conducting a market research study where a bottle of Whisky will be given to participants for their home use. The participants may also be asked to taste the product on my research premises. Are there any legalities I should know about before I start this project?

Thank you

Yes, lots of issues here. In some cases, a person furnishing liquor to others, if those others go out and smash the car, can be liable under the so-called Dram Shop Act.

You have to make sure that the liquor isn't given to minors.

I suggest you get a written waiver from the people, acknowledging that liquor can be dangerous if used improperly, that they do not have any medical condition that is affected by alcohol, that they won't give it to minors, that they won't drink and drive, etc.

Note that doing this through a corporation doesn't necessarily protect you from personal liability, as most people think.

There are many...and they are varied and too numerous to discuss simply via a bulletin board.

Please contact me to discuss same in the event that you need counsel.

Good Luck.
