Legal Question in Business Law in New York
attorney fees
We are planning on taking legal action on a company that never paid us for our services. The amount is over $20,000.00. The attorney says he gets 33% of the judgement. After we pay him that it will leave us still oweing for the material and labor of the job. Is that the usual fee or will the company also be responsible for attorney fees?

Re: attorney fees
Generally a contingent fee for collection is 1/3, however, this fee may be negotiated.
You cannot collect your attorney fee from a defendant unless there was a written agreement between you and the defendant prior to commencing the action (or unless a statute allows for your company to collect the fee).
