Legal Question in Business Law in New York
My brother works for a company in New York. A few months back he was given company gift cards to hand out at an event he was attending. He handed some out that night but he just told me that he had kept the rest of them. For the past few months he has been using them towards orders for his own clients (to help them out and to ensure he made the sale). The problem is he didn't ask for nor got the permission from anyone to do so. He also told me that he used a couple to place orders for himself.
He know believes that they might be on to him. What should he do?
Would admitting to it now, and possibly offering to pay back the $ he would owe be best? Understanding that he will get fired regardless is this the right move?
1 Answer from Attorneys
Your brother needs to contact an attorney immediately. Keeping the gift cards - and using them for his own benefit - is a criminal offense. An attorney can give him the correct legal advice and help him to resolve this situation.
