Legal Question in Business Law in New York
Business Certificate
I was issued a business certificate in 1998 in NY. I have never discontinued this certificate but when I went to check on my name, it had been given to someone else who has been operating under this name. I have the original signed copy with seal. Do I have any recourse?

Re: Business Certificate
If you paid taxes, or filed a return in the intervening years, you might. It isn't the business certificate so much, as it is a matter of copyright
law, protecting a unique business name or trademark/logo.
If the secretary of state closed you out for inactivity and you did not
obtain copyright protection, you really have no recourse. I need to know more.
