New business designation & liscensing
I am looking to open a veg. ''cafe''.
I would like to know if not having a ''full kitchen'' but merely a ''counter'' while having over 35 seats, (the majority of which will be couches,) will I be classified as a ''restaurant'' rather than a ''cafe''? Or, is there another designation altogether?

You do not give enough information to properly evaluate this question. There are many considerations involved not the least of which are the precise elements of the "counter" service contemplated, local ordinances and state laws. This is a venture that would best be done using an entity to protect you from personal liability. I strongly urge you to consult an attorney before going further with your plan.
