Legal Question in Business Law in New York

Business Law Question

My wife and I are about to start a small online auction business. We need a business checking account to do this. However, we have some credit problems due to my having a heart attack 2 yrs ago and being unable to return to work.

We need to know what business format (Regular Partnership, Limited Liability Partnership, etc) we need to set up in order to protect the business accounts from any of our personal creditors who might try to freeze those accounts.
