Legal Question in Business Law in New York
business litigation
I had a barter arrangement with a vendor. The vendor reneged on the agreement after 8 months. He is now sending me invoices for the work he did and not giving me an opportunity to barter. He also failed to perform responsibly and caused a project of mine to be credited.
He is now threatening to call my client and demand payment. Can he do this without going to court?

Re: business litigation
Was the agreement in writing? Not being in writing may not invalidate it but it helps to know what the agreement was. Whatever you agreed to -- in writing or otherwise will control who owes whom what and in what form of payment. In terms of his contacting your client directly, it's not possible to say for sure without many other details but it may be tortious interference with contractual relations -- or not. You should consult with a local lawyer.
