A case against fedex

Hello there,

Our company had recently placed a online order which was shipped using fedex. The service choice was standard overnight service. However, the package should have arrived today. When I have come to notice, they are unable to send it out today due to the fact that there are no drivers available and that their delivery arrived late to their hub. None of which is my fault. Fedex wants to now send the package to us tomorrow. They client now may NOT get the service from us because it was urgently dated for today. His contract would be $3k/month for a year. In which case, we lost $36K because of fedex's problems. Now, how should we proceed ? Should we file a case in civil court ? or federal court ? Please let me know or if we have good chance at it.

Please read the terms and conditions of Fedex use. Without having read them, I can bet dollars to donuts that there is a waiver of liability that you agree to that limits the liability to the cost of the package.

Now....calling and asking for a high level supervisor (do not be bashful)to complain may be a start, as would be some public relations aspects in these times of weak economy, but hey, this is not intended to be legal advice.
