Legal Question in Business Law in New York

Class action suit?

I was wondering if a class action lawsuit could be filed against Cingular wireless. I purchased an AT&T wireless free-to-go phone along with a $25.00 prepaid card. I found out that due to AT&T merging with Cingular, the phone and the calling cards are no longer valid. I would have to purchase a new phone and calling card that I already paid for! Is this legal? how could million of dollars in cash for prepaid cards no longer be valid because of a merger??

This is interesting. You may indeed have a very good argument if what you allege is true. If you have a moment please give the office a call -- there is no charge but we'd like to learn a bit more detail before giving you a definitive answer.

Re: Class action suit?

Are you sure that the merger has invalidated the use of the phone and calling card? In many mergers the surviving company still honors the obligations of the company they acquired. If, in fact, Cingular now refuses to honor the ATT matters, this could be cause for a class-action suit. As an aside, I use ATT and I have not had any problems.
