Legal Question in Business Law in New York
I sent some computer equip worth about $2,500.00 to a person in Atlanta, GA and I am in NY. He may want to add another $3,000. for presumably lost income. After 6 months the person wants to take me to court.
1.What state would the court case take if it were small claims court.
2.What state would the case be tried if the amount is $5,500.00?

As a franchise attorney I must say more facts are needed. Do you have a written contract and does it specify venue, jurisdiction, etc? The lost income part is probably not in play, but not enough facts are know. If he sues you in GA, the case is in GA, unless you object to the case being heard there. And that requires a legal filing, which in turn requires spending money to fight the action being heard there. Consult with a good business or franchise attorney in your area for specific advice.
