Contract Termination

On Tuesday November 18 at 6:12pm I signed a personal training contract at a gym. On Thursday November 20 I informed my personal trainer that I will not be able to keep the contract due to personal reasons. She spoke with her manager and called me back asking me to come in the next day Friday November 21 and see her manager. The next day the manager gave me a number to call and they will take care of it. I called on Friday November 21 at 2pm. Was my call on the 4th business day or the 3rd? I can cancel my contract within 3 business days from the date the contract was signed with no penalty.

It depends on the company's practice. Generally companies do not count the day of signing but start the period on the next day. In that case Friday is the third business day.

usually it is 3 business days from the signing. However, check your contract. The termination may have had to be in writing...in which case, you may be out of luck if you only called.

I am sure that when the company sues you for payment they will claim that you cancelled on the fourth day (if at all).
