Legal Question in Business Law in New York
Copyright Violation
A magazine I worked with printed a full two page spread with 10 of my images, this was in 2002, the images were one time use, editorial only. Last month (2004) they published an add and included the two page spread as a small image within the advertisement. Do they have the right to reprint my images if they copied the entire page or do I have a claim to copyright violation ?

Re: Copyright Violation
It seems from the facts presented that you certainly have a case if not for copyright then at least for improper and unauthorized use of your image..however, we would need some more information before making a complete and proper determination. Re: Copyright Violation
did u have an employment agreement, work for hire? any other agreement. If the facts are as you have stated, they have probably infringed on your copyright and may owe you damages. Please contact me with any questions.
Re: Copyright Violation
Possibly. It depends on the nature of the agreement you had with the magazine. Essentially it comes down to who had ownershp ofthe images as they appeared the first time.
