Legal Question in Business Law in New York

Damage to car in parking garage

I recently purchased a brand new car. I have a monthly parking contract with a garage. On the third day of parking there, I noticed damages to my vehicle. Unfortunately, I did not see the damage until AFTER I took the car out of the garage. As soon as I returned to the garage, I made a complaint to the attendant. What is the law with parking garages as far as damages to the vehicle goes? Is it true that once we take the car out of the garage, they assume NO responsbility even though I know for a fact that they had caused the damage? I plan on taking them to small claims court with this case, but do I have a chance of getting any sort of payment from the garage? What are my rights as a parking consumer?

Please advise! Thank you!

Re: Damage to car in parking garage

If this is a garage where you park & take the key, no chance. If they take it and keep the keys a small chance.
