Legal Question in Business Law in New York

Direct or InDirect Employment Clause

I am a computer consultant. My current contract ends next month. I have problems with my current agent regarding billing practices and representation. The question I need an answer to is as follows: Can I legally switch to another agent once my contract expires. The current clause states that 'I cannot directly or indirectly work for the client for a period of 1 year'. If the answer is no, are there ways around this. Thanks for your help.

Re: Direct or InDirect Employment Clause

It is unclear from the details you supply--one year from what? any type of termination of the agent/consultant agreement? just if you terminate the agreement early? If you believe you have a valid complaint against your agent--i.e. s/he has cheated you in terms of your billings, then a negotiation is in order: you agree to waive your right to sue him/her on this issue and s/he waives the non-compete clause as to this (all, some, whatever) client(s).
