Legal Question in Business Law in New York

Our family business upgraded our front desk and back office computers that control our bowling business for almost $40,000 about a year ago. The computers allow us to turn lanes on and off as well as make sales on items. We have had nothing but problems. The new system seems to be causing lots of problems with the scoring terminals and we have spent another 8000.00 in replacing items. We seem to be on the phone with tech support 2 times a week. Our customers are not happy. At this rate we will be out of business. Is there anything we can do?

It's hard to say what your remedies could be without taking a look at the contract you had/have with the company who provided and installed the systems.

Generally speaking, if they are not willing to address your issues and/or issue some credit you would need to to present them with a money damages demand and possibly file a law suit. If you have any additional questions, feel free to contact my office at your earliest convenience.

You may sue for breach of contract and consequential damages upon submission of proof evidencing negligence, malfeasance or nonfeasance. Are you free of contributory fault? A computer expert may be your best bet in determining the existence of a cause of action.
