An alien is permitted to own and invest in a U.S. company and draw dividends, however the alien CANNOT work for the entity and draw salary without the proper visa. Many companies, their principals and aliens get in trouble because they do not understand the various restrictions and distinctions that exists and it is therefore highly advised that you consult an attorney.
I would be happy to chat with you further. Feel free to contact my office at your earliest convenience.
