Re: frivolous lawsuit

You need to file an answer to the complaint. You typically have 20 days if you were served personally, 30 if by any other method. In the interim, you can try to negotiate a settlement with the plaintiff.

In either event, you should have an attorney review the complaint and discuss the issues with you. You should do this without delay.

Re: frivolous lawsuit

You simply must take the summons and complaint to an attorney as soon as possible.

Re: frivolous lawsuit

At this point you should really retain an attorney before taking the next step, so you can clearly understand all your rights. It is possible you could make a mistake in the early stages that may have adverse consequences later on even if you are right on the facts.

Re: frivolous lawsuit

While the previous answers are all on the right track, unfortunately, because a corporation can not file an answer on its own, you need to retain an attorney - and do so quickly.

If you'd like to discuss the situation, please feel free to get in touch, either via e-mail or phone.

As the other attorneys have advised you, you need to retain an attorney to prepare and serve an answer on behalf of your business. This should be done promptly to avoid a default. My firm regularly handles commercial litigation and I would be happy to discuss this in more detail with you. Please feel free to call at your earliest convenience.
