Legal Question in Business Law in New York
I helped a friend finance a large portion ($65000) of his business (Funeral Home), with the agreement that we would have a written contract between us. It is now going on 3 years and he has not come through with a contract and I know want my money back because of his neglect, lack of communication and avoidance.
What can I do?
1 Answer from Attorneys
You can send him a demand letter threatening a lawsuit for breach of contract; however, you need proof that a contract exist. For example, copies of cancelled checks or any evidence that you gave him the money to start the business will be essential to prove your case. If you have such evidence, you may want to consider hiring an attorney to help you resolve this matter without crearting too much animosity between you and your friend.
