Legal Question in Business Law in New York
My husband opened his own business after his former boss promised to give him both his equipment and contract business to him after he closed shop in November. His former boss is now avoiding him and not giving him the business he promised because he feels slighted that he doesn't have the same control he did as a boss. My husband would have never started his own business if he knew his old boss would back out of giving him the business he promised. What legal options does he have?

Unless you have a written contract then you are going no where with this. This is not to say that verbal agreements cannot be enforced, but how are you going to prove that your husband relied on his employer's promises to his detriment? I mean, are there any emails or text messages? Anything that validates your complaint?

Do you have any witnesses to the oral agreement? Any circumstantial evidence supporting your claim whether through paper work or conversations with third parties? What benefit would accrue the former boss if he followed through with his promise; i.e. what is the consideration for the underlying promise?
