Legal Question in Business Law in New York

Illegal Use of Image

Approximately 8 years ago, I had some photos taken of my image that were distributed without my consent. This photo now appears on a public site, endorsing a product, using my likeness for advertising. I have written a cease and desist to the web author and site owner, and they have no interest in deleting the illegal material. What recourse do I have at this point?

Re: Illegal Use of Image

You can sue for damages, and seek an injunction against further use of the image.

Re: Illegal Use of Image

If your main concern is getting the image down, and you never gave permission to them to use those photos, then a well drafted letter to their ISP should get them down. That would not get you damages, but it would not keep you from still suing and you would get the website shut down if they don't quickly remove the images. Feel free to contact me on this for a letter to their ISP.

There are various options which you may wish to chose from, those have already been discussed with you in previous messages. Overall, if your interest is in ganing money for damages for this illegal use, and teaching them a lesson, you may opt to file a lawsuit.
