internet fraud (i think)
can i sue apt brokers for violating the terms of use on craigslist? they post under the ''by owners only'' section when it clearly states that they are not allowed to. the terms say that if they charge any fee, whatsoever, they mustnt post under ''by owner only''. yet nearly all of the listings in that section are brokers or agenices charging high fees and using bait and switch tactics.

If you can sue or not is going to depend on who the intended beneficiary of the restriction is. If it is designed to protect you, the user, then you may be able to act. On the other hand, if it is designed to protect the list, as in the owners of the list, then you may lack standing to bring an action.
