Legal Question in Business Law in New York

Professor D is hired by ''Towers University'' to teach business la at--name removed--salary of $3000 per month. After school has been in session for 2 months, the Business Administration Building is desptroyed by fire. The university refuses to pay him any further salary claiming they are discharged from their obligation of performance. Is the University discharged from its obligation of performance? Is prof. D discharged from his obligation of performance?

Perhaps yes..perhaps no

Ther is a doctrine of Impossiblity of performance which might relieve them..but i might suppose that would come into play if they were offering no classes any longer.

More information is needed. In particular, was the employment agreement in writing or oral. If in writing, what are the exact terms and conditions of the employment agreement.
