Legal Question in Business Law in New York
Is it legal to charge a fee for resubmitting bills to customers
I received a bill from a store in town charging me extra for mailing a bill to them . It was listed as a resubmit fee.
Is this legal ? As I did not sign any contract that said agree with this term or condition. Did not verbally agree over the phone. or even sign the bill or reciept. Since they are a flower shop that deals in retail only is it legal since the acount was basically just a phone in and they said they could send me a bill. the bill is now overdue due to this argument and the cost is growing as to what they say I owe them. Do I have to pay this fee which has now added almost 100 dollars on to my original bill.
or am I only obligated to pay for the goods purchased.

This is hard to tell..is there any signage that states this in the establishment? Did you pay with a charge card? If so, dispute the charge. If not, write back to dispute the bill and ask for where you were informed of it and send the letter certified and regular mail.
If they sue you for the $100.00, you have proof that you asked and nothing came. If it will screw up your credit report, then pay it, and sue them in small claims to get it back after they send you no proof after asking.
Good Luck
