Liquor Employee Liability + Fairplay

This afternoon upon arriving at work, the owner of the specialty wine store answered to my usual, ''Good morning whats up?'' with ''Well, you're fired.'' This took me aback, as 1 i have never been fired from a job and 2 i was a dedicated and dilligent worker at the store.

The situation is as such. I am twenty. During my two week tenure at the store i both tasted wine in store as well as was sent to tast wine off the premises. At no time durring my relationship with any of my employers was a verbally asked my age; on the tax and other employment forms i was completely forthcoming as to my age as well as all other relavent information. I asked why I was being fired and received the reply ''Because you didn't do the right thing.''

After my first day of work the owner gave me a bottle of wine. It was not till my last full day of work, saturday (6/8/2002) that i was asked my age, by a manager and told that i wouldnt be fired, today I was. Is there any kind of recourse or recompense that i can seek? Any information you can provide will be accepted greatfully. Thank you for your time.

Probably not-you are an at will employyee. Had the owner been diligent, you should not have been hired in any event.

This should not stop you from filing for unemployment, should you meet the service requirement for that.

New York is an "employment at will" state. That means that either the employer or the employee can end the working relationship for any reason at any time.

Consequently, I doubt you have much recourse. (Even the remark that you "wouldn't be fired", in my opinion, does not rise to the level of detrimental reliance.)
