Legal Question in Business Law in New York
neighbor bothered by bush
my neighbor would like us to remove a bush whose branches extend onto her property. She claims the bush is dead anyway. Is it O.K. just to say that she has permission from us to trim any part of the bush she wishes?

Re: neighbor bothered by bush
If it's on your property, it's your bush. If you want to tell your neighbor to "remove any part of the bush she wishes," that's fine, as long as you understand that you're giving her carte blanche to remove "any part" which may be deemed to includes branches, trunk and roots -- i.e., the whole thing.
You and your neighbor must decide between you who pays for the bush trimming, and you don't need a lawyer to get involved unless someone digs in their heels about this. It is your bush and you have an interest in maintaining the bush; but the bush extends onto her property, which she has an interest in maintaining. Costs like this one often get split equitably between the bush's owner and the neighboring property owner.
Good luck.
