Legal Question in Business Law in New York
Nonpayment of services rendered
I've been a freelance consultant for an architectural firm for six years and this relationship was severed within the past couple of months. I have not received payment for outstanding billing totaling nearly $12,000. There was never a written contract with the firm for my services but I had always received payment of prior billing in a timely manner(within weeks of submission). The owner has refused to answer calls or respond to my prior correcpondence. A separate letter from counsel went out to the business demanding a response within seven days but that period came and went and no payments were received.
Understanding that I can turn this matter over to a collection service or pursue traditional litigation are there any other legal avenues I can follow to collect this unpaid billing here in New York State.

Thank you for your inquiry. This response is for informational purposes only and should not be construed as legal advice.
I am led to believe by your question that you have counsel and that your counsel has prepared at least one letter to the non-paying entity. If in fact you have counsel, your question should be directed to him/her; it is improper for an attorney to counsel on an issue if in fact other counsel has been retained for that matter.
Thank you again for your inquiry.

Those are the only legal methods that I am aware of. Feel free to contact me directly, if you need any help.
Re: Nonpayment of services rendered
That is generally about it.
Your costs for both will probably be about the same. (I do both collections and commercial litigation). The matter has to go into County Court in White Plains if the defendant firm is Westchester, or in Supreme Court in White Plains if the defendant is in NYS in general.
Feel free to contact me with any questions.
Good Luck.
