Legal Question in Business Law in New York
In NYC we have a business. We fax a credit application to our potential customer who signs a personal guarantee. The customer faxes back the completed application signing the guarantee. Is this a legal enforceable document or does the original signed application have to be mailed to us to be valid? Will the courts today accept the fax?

Q. Is this a legal enforceable document
A. Yes. The Courts will accept the fax, although as a lawyer I would prefer to use an original document.
