Legal Question in Business Law in New York

Partnership to be dissolved, Will be sole proprietor.

Business Partnership to be dissolved. I will be doing the same work as a sole proprietor. Can I keep the name of the business? If I keep the name of the business will my ex-partner be able to lay claim to any money I make ?

I will be operating this business from my home, NOT from the location when it was a partnership. I can not keep the same phone # due to location. Old phone will be shut off. Can I have the phone company put an intercepter directing calls from the old phone # to my existing home phone #, not a new business phone # with out being legally responsible for pastdue phone bills from the partnership?.

You can keep it however, you should file a business certificate for this trade name. Once the partnership dissolution is filed your partner should have no future claims. Dissolution does not waive your past debts. I doubt the phone company will work with you until all debts are paid. Good luck.
