Legal Question in Business Law in New York

Posting of ''request for a coupon'' by visitors on my site

This is trickly. Our site, WheresThatCoupon.com allows visitors to search for local restaurants and businesses. We are a new service so we don't have many coupons posted yet. Visitors can post their ''request'' for a coupon. We list the request and the store/restaurant on the site. Our intention is for merchants to see the request, sign up on our site, and send a coupon to the prospective customer. Here's the question: Are we within legal bounds to post a ''request'' for a coupon? Can restaurants and store owners force us to remove the posting of the request? Is this not free speech? Any help is greatly appreciated.

Thanks, Steve Meyers

Well, it is clearing not free spreech. You are making money and using this as commewrcial enterprise. A commercial enterprise that uses someones name and good will. It probably would have made sense to speak with a lawyer before you started the venture.

Good Luck

You probably want to have certain waivers and consents signed by the stores in order to protect you against any claim of misappropriation however I would need to understand exactly how your website works and how it identifies its customers to be more specific.

Feel free to contact me should you wish to discuss this further.

Kind regards,
