Legal Question in Business Law in New York
problem with promissory note
at my former place of employment, i was given a promissory note with 0% interest. payments were taken directly out of my paycheck. i never received copies of statements or details in regards to anything. to my knowledge it has been paid off in full but my former employee claims $0 was paid and are charging an additional 60% in collection fees! i dont have any proof except that the documents they claimed i signed are forged, i joined the co. under false information, the co did not pay my professional privelage tax which was taken out of my pay so the irs is claiming i owe them money + penalties/late fees, my paystubs and 1099 dont match up at all, can any of the info i have be used against them? is there anything else i can use as defense?

Re: problem with promissory note
You can challenge the collection and force an accounting of the payments. The IRS will be a bit more difficult so you might want to consider getting an attorney to help you with the other items as that will likely be necessary in correcting your problems with them.
When faced with such a situation as yours with multiple parties and governmental issues, it is best to have an intermediary to handle the situation. Additionally you may need to sue your former company in order to get the materials necessary to prove that the funds were paid and that they didnt pay the taxes as required.
I'd be willing to discuss this in detail to determine if I can assist. If you are interest, please contact my office.
