Re: Process Serving

You cannot serve on Sunday nor on Saturday to a Sabbath observer.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

Re: Process Serving

In New York State, anyone 18 or older and not a party to the lawsuit can serve process on an individual or a corporation on Monday through Saturday if no extenuating circumstances exist. No service is valid on Sunday.

Extenuating circumstances consist of your knowing that the person you are serving celebrates their Sabbath on Saturday (for example, the Jewish community). In that case, service on Saturday is no good.
