Legal Question in Business Law in New York

Product Fraud

My mom ordered a camera and camera bag from an internet company doing business in Brooklyn, NY. The camera bag she ordered was a Samsonite and the customer service person gave her a discount, since she was purchasing the camera, of $10 and sold her the bag for $19.99. The bag she received looked identical to the online picture of the Samsonite but it was an off-brand, one we did not recognize. I looked on the company's website and they do not sell this particular brand of camera bag. They made no mention of any substitution for a Samsonite bag on the invoice. Would this be considered product fraud?

Possibly, you can contact the State Attorney General and the Better Business Bureau and make a complaint, if you paid by credit card, dispute the charge and make a complaint. You may also want to contact the web host.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
