Use of Proxies

Our home owners association had to adjourn its annual mmeting due to lack of proper notices(as per its by-laws)

with regards to its nominated slate for directors. An

alternate slate was then filed by some of its members.

A new proxy form was mailed to all members with both slates

contained on it. The association now is intending to use

proxies from the adjourned meeting plus any new ones received.

I believe this to be wrong as new dated proxies were mailed

to all members and should be the only legal proxies.

You are permitted to vote in person or by proxy.

I don't understand exactly what happened, but if the by-laws were violated, or some other unfairness took place, then you might need a court to undo what was done. If the new Board will take actions you feel are not authorized, you need to make an emergency application to the court. Please feel free to contcat me if you need further assistance.
