Legal Question in Business Law in New York
I have a quick question. My dad is an employee (the only one) of a small business. When he was hired 13 years ago the owners made him sign a paper stating he would not go work for someone else in the same field if he was to leave them. He signed because he needed the job. They had the paper notarized. Is this legal? Can they really prevent him from going out "on his own" in the same field? He is 66 and cannot do any other work, this is specialized work and he is REALLY good at it, and the community loves him, and would prefer to go to him (bug killing, go figure) his current boss rides him hard and we are all tired of it. My mom is ready to possibly start a business on her own, but wants to know how hard it will be to break this so called "slave contract". Thank you

It called a non-compete agreement. Ask your dad to take the agreement to an employment law attorney for review and advise.
