Legal Question in Business Law in New York
refund for unused classes
i enrolled in a sailing school course which consists of 3 classroom sessions, 3 hands on sessions and 1 sailing session. I paid in full ($240) and went to my first class. After going i decided this isnt for me. I asked for a refund via email and the owner didnt respond, then i called repeatedly and finally after a month i got thru to the owner who denied me a refund. There was not a norefund policy posted on their website or the receipt (it was a bank debit charge) in fact, there is not a refund policy posted anywhere .
what can i do to get a refund?

Re: refund for unused classes
You can try taking the owner to small claims court and ask the judge to come up with an equitable refund for you to receive. You do not need an attorney to help you do this; the clerk of the small claims court in your county will give you the forms and instruct you on how to fill them out.
Note that if you signed a contract, the judge will be bound by its terms. If you clicked through on a website, the terms that existed on the day you clicked through govern, so make sure you print them out before you file a complaint in small claims.
Good luck.
Re: refund for unused classes
If they are located in New York you could sue in small claims court, for $20. If they are not located in New York, the amount is too small for any
other jurisdiction. You might complain to the BBB. But you will be wasting your time with anything else.
