Legal Question in Business Law in New York

Retailing responsibility

Hello--

I'm interested in locally retailing my homemade beauty products (bath oils, lotions, lip gloss, etc.). I'm uncertain what my legal responsibility is if someone were to have an adverse reaction to a product. Do I need to include an explicit disclaimer in the packaging? Get liability insurance? Or..?

Thanks so much for your time.

Re: Retailing responsibility

Generally, if you sell such a product, it is wise to obtain :

1. a broad form vendors endorsement from the manuf. and/or distributor, and

2. liability insurance for yourself.

Keep copies of the broad form vendors endorsement from the manufacturer as this will be your first sourse of insurance coverage. Your policy should protect you from any claims against you in the first instance, but turn any claims over to both.

Be certain to have a good insurance broker.

Good Luck
